...Court instructs appeals committee to allow PowerGen Sports a fair hearing

THE TRINIDAD and Tobago Cricket Board (TTCB) has given an undertaking to the High Court that it will not move to consider a complaint by PowerGen Penal Sports Club that will have the effect of determining the Premiership Division 1 champions.
The undertaking was given yesterday during a hearing before Justice Karen Reid, in which PowerGen was seeking an injunction against the TTCB to prevent it from adjudicating on the complaint.
That adjudication was to take place at 7 p.m. last night by the board's national appeals committee. Given the undertaking, the committee will not hear or determine the club's complaint until the matter is fully ventilated in court.
The sports club is challenging the committee's jurisdiction to adjudicate on its complaint.
While she initially heard the application, Justice Reid has adjourned the matter to the docketed judge, Justice Avason Quinlan-Williams who will then set further directions for the progress of the injunction application and the one for judicial review.
Representing PowerGen Sports Club are attorneys Gerald Ramdeen and Dayadai Harripaul.
The matter stemmed from PowerGen initially filing a protest of their second-round two-day match against Victoria United at Victoria's home venue, the Daren Ganga Recreation Ground in Barrackpore.
There was no play on the first day of the game owing to an unfit pitch. Play commenced on the second day and the game ended in a no result. PowerGen are claiming full points from the game.
If successful, they will be crowned champions.
The National League Disciplinary Committee initially sat on the matter without informing both clubs and the umpires and ruled against PowerGen as they upheld the original result of the match.
PowerGen, however, then appealed that ruling, arguing that the parties were not given an opportunity to be heard. The national appeals committee said the matter had to go back to the Disciplinary Committee on the basis that Power-Gen were not given a fair hearing.
